Whereas, Confetti pollution is wasteful, a detriment to the environment, hard to clean up and a danger to wildlife,

NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS:

Section 1. Confetti is defined as small pieces or streamers of paper, plastic, mylar, or metallic material thrown at celebrations, especially parades, that pollute the environment.

Section 2. It shall be unlawful and an offense against the city for any person to throw or dispense confetti on public property.

Section 3. Any person violating this Ordinance shall, upon conviction, be guilty of a misdemeanor and fined an amount not greater than Fifty Dollars ($50.00) for a first offense and not greater than one hundred dollars ($100.00) for a second or subsequent offense .

Section 4. If, for any reason, any portion or portions of this ordinance shall be held invalid, such invalidity shall in no way affect the remaining portions thereof which are valid, but such valid portions shall be and remain in full force and effect.
