Ordinance goes into effect 10/26/2024
WHEREAS, prior Ordinances of the City of Eureka Springs, Arkansas, and Act 812 of 2019 of the Arkansas State Legislature allow for the creation of permanent entertainment districts and setting reasonable standards for the regulation of alcohol possession within the district; and
WHEREAS, this ordinance is intended to promote hospitality and tourism within the
City, to highlight restaurants, nightlife entertainment and hospitality options to tourists, and to create standards for the regulation of alcohol possession within the boundaries of the designated entertainment district.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EUREKA SPRINGS, ARKANSAS:
Section 1. Location: The Location of the Entertainment District commonly known as Pine Mountain Village. A property survey and highlighted boundaries are attached hereto as Appendix A with the exception of the tower.
Section 2. Signage: Signs stating “End of Entertainment District No Alcohol Beyond This Point” must be erected every 40 feet across the front of the Pine Mountain Property, from the east property line, following the Entertainment District Boundary along Highway 62. A sign must be posted on both sides of the entrance gate of the tower indicating that the Tower is not part of the Entertainment District, stating “No Alcohol Beyond This Point”
Section 3. Dates and Times hereby permitted: District is authorized to be in operation from 10:00 A.M. until 10:00 P.M. seven days a week.
Section 4. Identification of Participants: Those persons who wish to possess or consume from an Open Alcoholic Beverage Container within the District, or enter the District from a permitted Alcohol Beverage Establishment with an Open Container shall first obtain an orange Identification Wristband with the words “Pine Mountain Entertainment District” printed in black ink. No Container used to contain alcoholic beverages removed from a licensed vendor's building shall contain more than 24 fluid ounces.
Section 5. Applicable state and local laws: All laws and ordinances not addressed herein shall remain in full force and effect. The permission to possess and/or consume alcoholic beverages under this Ordinance and any similar Ordinances shall not be construed to allow anyone to possess and/or consume alcoholic beverages from any container in a vehicle.
Section 6. Removal of Alcoholic Beverages from the District by participants: It shall be unlawful for any person to remove an Open Alcoholic Beverage Container from the Entertainment District. All unfinished quantities of Alcoholic Beverages must be properly disposed of prior to the participant leaving the entertainment district.
Section 7. Police and Fire Authority: Nothing in this Ordinance prevents the Chief of the Eureka Springs Police Department or the Chief of the Eureka Springs Fire Department from suspending the operation hours of any Entertainment District if necessary to comply with local, state or federal law or fire codes, or as necessary to protect the public health, safety and welfare.
Section 8. Expiration Clause: This Permanent Entertainment District shall expire two (2) years from its passage unless further action is taken by the Eureka Springs City Council. Should the City Council find it necessary for public safety, this Entertainment District created by this Ordinance can be suspended or terminated by passage of an appropriate ordinance. Should the property of the Permanent Entertainment District sell, then the Permanent Entertainment District shall be terminated unless further action is taken by the Eureka Springs City Council.
